These terms are between you and Tell Jessica, the operator of telljessica.com.

Using the site

These terms cover your use of the Tell Jessica website at telljessica.com. By using the site, you agree to these terms and to our Privacy Policy.

You may browse the site if you are able to enter a contract. Please don’t misuse the site. That includes trying to break it, overloading it, or scraping it in a way that harms it.

The app is for iPhone

Tell Jessica is an iPhone app. It is not an iPad app, an Android app, or a web app. It may not be available for download yet. A button on this site that says “Coming soon to the App Store” is not a purchase and does not reserve a copy.

When the app is on the App Store, you download it from Apple. That download is under Apple’s terms. We do not promise a particular launch date.

Features described as upcoming, including Morning Brief and Snap a schedule, may change, be delayed, or not ship. Example conversations on the site use made-up names and events. They show the kind of help we are building. They are not a promise of a particular screen or a particular result.

Subscriptions

Tell Jessica is a paid app. Subscriptions are purchased and billed through Apple’s App Store, under Apple’s terms. A subscription renews automatically unless you cancel it in your Apple ID settings. Apple handles payment, billing, and cancellation. This website does not charge you and does not receive your payment details.

Apple is the seller of record for the subscription. If Apple’s checkout shows a different price, tax, or term, Apple’s checkout controls that purchase.

Intellectual property

The site, the Tell Jessica name, the mascot, and the text and design of the site belong to Tell Jessica or its licensors. You may link to the site. You may not copy the mascot, the name, or the design to offer your own product, or suggest that we endorse you.

iPhone and the App Store are trademarks of Apple Inc., registered in the U.S. and other countries. Apple is not a sponsor of this site.

Disclaimers

The site is provided as is and as available. We do not promise that it will be uninterrupted or error-free. Information on the site is general information about a product we are building. It is not legal, medical, financial, or other professional advice.

To the fullest extent allowed by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of liability

To the fullest extent allowed by law, Tell Jessica is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or the cost of substitute services, arising out of your use of the site. Our total liability for a claim about the site will not exceed the amount you paid us to use the site in the twelve months before the claim. Browsing this site is free, so that amount may be zero. Subscription fees for the app are billed by Apple, not by this website.

Some states do not allow certain disclaimers or limits, so some of the limits above may not apply to you. These terms do not limit liability that the law does not allow us to limit.

Governing law

These terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-law rules. Courts located in the State of Texas are the venue for disputes about these terms or the site, except where a law that applies to you requires a different venue. You and Tell Jessica agree to that venue.

Changes

We may update these terms. The new version will be posted on this page with a new effective date. If you keep using the site after that date, the new terms apply to that use.
